The court judge, The Honorable Diane Dal Santo, presided over the plaintiff request for a temporary restraining order against Games Workshop. Based on the potential damage to the three distributor plaintiffs, the requested restraining order was granted by Judge Dal Santo at 10:45 Mountain Standard Time and was effective immediately. The restraining order provides for the following: a. Enjoining Games Workshop from selling its products to plaintiffs' customers b. Enjoining Games Workshop from selling its products to any retailer customers that it had not sold to prior to August 15, 1995 c. Ordering Games Workshop to chage the pricing and terms and conditions of sale (including shipping and delivery terms, schedules and priorities) of its products to distributors and retailers to what they were prior to September 1, 1995 d. Enjoining Games Workshop until further order of the court from changing its prices or the terms and conditions of sales of its products to either distributors or retailers in a way that would, as a practical matter, impair the ability of Plaintiffs to continue to act as distributors of Games Workshop's products e. Enjoining Games Workshop from any future contact of any of the plaintiff's present or future retail customers f. Enjoining Games Workshop from imposing any credit limitations of Plaintiffs' accounts which are more restrictive than the largest amount of credit which plaintiffs had outstanding during the latest twelve months so long as plaintiffs pay all amounts owed in accordance with Games Workshop's normal credit terms A preliminary injunction hearing will be scheduled within the next two weeks, at which time the merits of the case will be fully heard. The plaintiffs intend to file discovery motions for information which they believe will more fully portray Games Workshop's alleged violations of the law which include improper interference in business relationships, fraud, and violations of the Federal Anti-Trust Act and New Mexico Trade Secrets Act among others. Comments, discussion and/or known violations of the above restraining orders should be forwarded by fax to 505-242-3540.
