Smith Jr. on Friday, but attorneys were tight-lipped about the brief conference. Asked what, if any, concerns were raised by the juror, defense attorneys refused to comment. The alternate juror, one of six chosen to hear the case, was excused when the 12-member jury began deliberations Wednesday afternoon. But Mike DeGeurin, who represents defendant Paul Fatta, said the alternate juror's concern prompted him to ask the judge to rule on a motion related to their conversation. Although he would not say what the motion involved, DeGeurin said Smith rejected the move. DeGuerin did say, however, that the motion was not for a mistrial. The jury was scheduled to resume deliberation Saturday morn- ing, but it is to skip work Sunday and take up the task Monday. Defense attorney Rocket Rosen said the alternate juror had come to the federal courthouse to tell defense attorneys they "were doing a good job," but Rosen refused to discuss the remainder of their conversation. "I'm not going to breech [sic] that alternate's confidence." In other developments, jurors Friday watched two videos of a raid on the Mount Carmel compound near Waco and listened to the tape of a 911 call made minutes after a gunbattle erupted at the site last Feb. 28. The jury also got transcripts of the 911 tape shortly after they reconvened Friday, said Jo Simpson, a spokeswoman for the U.S. Marshals Service. One of the videos was from a Waco television station, and the other was taken from a government helicopter.
