HELP BRANCH DAVIDIAN CIVIL SUITS Right now there are a number of separate civil law suits against the government. Some are being conducted by big law firms which evidently have some resources. Two of the most important ones are experiencing some financial difficulties. I will describe their efforts and you can help them if you like. The Cause Foundation P.O. Box 1235 Black Mountain, North Carolina 28711 (704) 669-5189 North Carolina's Cause Foundation is representing families of 23 deceased Davidians and two survivors in lawsuits seeking tens of millions of dollars. Their first lawsuit, on behalf of the family of Aisha Gyrfas Summers, 18, and her child Startle Summers, 1 year, who died during the fire, was filed against the U.S. Government, Bill Clinton, Janet Reno, and the whole rogue gallery of culpable BATF and FBI agents and officials. The suit makes a number of critical allegations: that the Davidians were "separatists preparing for days of tribulation" and the government wants to destroy such groups; that undercover agent Robert Rodriguez gave false information because he was angered by David Koresh's showing him the Gun Owners of America video; that the raid itself was a conspiracy; that Ted Royster fired into Mount Carmel from a helicopter; that BATF and FBI agents engaged in a conspiracy to sabotage negotiations and spread disinformation about the Davidians because they wanted to avenge the deaths and woundings of other agents; that the FBI tried to arrest Gyrfas and her daughter with no warrant or cause; that the FBI's chief negotiator made a public statement over loudspeakers that the FBI should kill the Davidians; that although Koresh had agreed to surrender peacefully, defendants had no intention of allowing him to do so; that defendants gave Janet Reno and Bill Clinton inaccurate information in order to obtain approval for the raid; that the tank attack caused structural failures in the building that killed some Davidians; that defendants continued the attack even when the knew the Davidians would not surrender; that whether the fire was caused by accident or the action of any Davidians, defendants remain legally responsible. In the Gyrfas case, the government argued that the court did not have In Personam Jurisdiction over the federal agents who are not resident of Texas. The Cause Foundation calls this the "We Came, We Killed, We Fled" defense. The court did dismiss the Gyarfas suit against BATF, ruling it had not harmed the deceased woman and her child, but did allow the lawsuit against the FBI and Justice Department to continue. Kirk Lyons, executive director of the Cause Foundation, asserts that the suits are intended less to compensate the victims of the government's excessive use of force, than to defend the U.S. Constitution from government encroachment and ensure that another situation like Waco never happens again. "By winning a civil suit against the agents, we can seize their houses and make their families homeless, and other agents will remember and perhaps think twice before squeezing the trigger or engaging a gear shift." According to the Cause Foundation's most recent fundraising letter they are experiencing great financial difficulties. They are relying on the personal finances of the Foundation's employees, at this point. They are winning as far as getting information out of the government--but still could end up having to shut down their cases and even their operations. Contributions are critical at this point. Former U.S. Attorney General Ramsey Clark is the lead attorney in lawsuits totalling more than $900 million for the families of David and Rachel Koresh and their children and the Jones' family and for many of the survivors. Clark, who is working with the Louisiana firm of McQuaig and Solomon, said the government violated a number of federal rights including freedom of religion and movement. While Clark may have a big name, he evidently has not been able to raise certain monies necessary for autopsies on some of the deceased. Right now Davidian survivors have an injunction against the coronor burying these bodies--and their evidence of government crimes against the Davidians, according to Davidian supporter in Waco, Dewey Millay. If you would like to make contributions to help with the autopsy, write a check to the Mount Carmel Survivors Memorial Fund, Inc. and earmark it "Autopsies and Burial." (Many of families are too poor to bury the bodies; some bodies remain unclaimed by families.) If you would like to help the Davidian prisoners or to help make sure the Davidians keep Mount Carmel property and build an appropriate Memorial there, earmark it thusly.
