Subject: Resolution from Gun Rights Policy Conference

This resolution was passed overwhelmingly at the 1993 Gun
Rights Policy Conference hosted by the Citizens Committee for
the Right to Keep and Bear Arms and the Second Amendment
Foundation. (9 September 1993)

     CCRKBA and SAF personnel were opposed to the
resolution; they believe that in the world of practical
politics, the Insta-Check is the way to go, in the hope of
defeating Brady.  The sponsors of this resolution believe
that should Insta-Check become law, the whole issue of prior
restraint will become indefensible in court in the future.


              OHIO CONSTITUTION DEFENSE COUNCIL


Resolution:

Whereas: Laws requiring individuals to wait, to obtain
consent, or to prove they are capable of properly exercising
their rights before permitting them to exercise their civil
rights are all forms of prior restraint, and

Whereas: Prior restraint of a civil right is unconstitutional
because it negates a fundamental right by subjugating the
right of the individual and changing the right to a
privilege, and

Whereas: Instacheck constitutes prior restraint of
fundamental individual rights, and

Whereas: There is no credible evidence any background check
or other form of gun control has slowed the illegal traffic
or misuse of firearms, and

Whereas: Instacheck would likely lead to a computer list of
all firearms purchases and purchasers, and

Whereas: Once the doctrine of prior restraint has been
legitimized, then a dangerous precedent is established,

Therefore now be it resolved that this body reject any type
of prior restraint whether it be in the form of a background
check, one gun per time period or waiting period.

Remember: Rights delayed are rights denied!
