		Assault Weapon Bill

What the Bill Does:

Defines an Assault Weapon
	67 Named firearms are defined as assault weapons
	Three firearms features are defined as assault weapons:
		Flash suppressor
		Bayonets, bayonet lugs and grenade launcher
		Night sites

Bans the Sale Possession or other transfer of Assault Weapons

Exempts of Grandfathers certain uses:

-Law Enforcement Officers Exempt:
Federal agents, military personnel and commonwealth officers agents or
employees are exempt, provided they are licensed to carry weapons by a
competent authority and are acting within the scope of their duty.

-Collectors and exhibitors Grandfathered:
Collectors and exhibitors are grandfathered for possession of their Assault
weapons, provided they have a valid FID card and a license to carry of a
license from another jurisdiction that requires a felony check.  Display of
use allowed in limited locations.  Weapons must be secured during
transport.

-Executors and administrators exempt:
Executors and administrators may possess assault weapons during the period
that an estate is settled, provided weapons are help securely and transfers
are made only to holders of valid FID cards and licenses to carry.


What this bill means for current owners of assault weapons

-They WILL be allowed to:

Own and possess operable assault weapons --if they owned them prior to the
effective date of this legislation and if they obtain a license to carry,
which requires a background check.  (ed note: start shopping now)

Own and possess assault weapons obtained after the effective date of this
legislation, provided the newly acquired weapons have been rendered
permanently inoperable

Collect and exhibit lawfully possessed assault weapons

Target shoot with lawfully possessed assault weapons at shooting and gun
clubs

Transport weapons to exhibitions, gun clubs, shooting clubs, and guns shops

Bequeath their assault weapons to heirs (ed note: buy some for the kids)

Sell their weapons to licensed gun dealers of sell then in another
jurisdiction where it is lawful to do so

Donate their Assault weapons to federal, state or local historical society,
museum or institutional collections that is open to the public, provided
the weapons are maintained in a permanently inoperable condition, properly
housed and secured from unauthorized handling.

-The WILL NOT be allowed:

Own and possess operable assault weapons obtained after the effective date
of this legislation

Own and possess operable assault weapons acquired prior to the effective
date of the act if they are unable to obtain a license to carry and clear
the associated background check.

Hunt with assault weapons

Sell, distribute, trade rent, give or otherwise transfer assault weapons
within Massachusetts, except to a licensed gun dealer or pursuant to the
laws on descent and distribution

-Penalties for violations of this proposed stature:

Up to a one year penalty for unlawful possession

Up to a two year penalty and/or $500 fine for illegal transport of assault
weapons 

Up to a five year penalty for illegal sale

Up to a ten year penalty for a sale to a person under age 18

No possession penalty for person (sic) who surrenders a banned assault
weapon to law enforcement authorities

-New requirements that assault weapons owners report thefts

Owner must report a theft within 72 hours of discovery or incur civil
liability for damages arising out of commission of crime with his/her weapon
