According to Perpich vs Department of Defense (1990?), the NG is
ultimately under control of the Federal government. The name of a
given state in any NG designation just indicates that that state may
use them under certain conditions, and that that state pays for most
of their upkeep while the Feds aren't using them.

And except for times when martial law is declared, if the Feds call
up the NG, they can't use them for law-enforcement duties without
violating the Posse Comitatus Act.

Not that that's certain to keep them from being so misused. :{
